EUBACCI believes that most issues are best resolved through a structured, respectful dialogue. This page explains when we can help and how to start the process.
Scope – what this covers
This process is intended for matters that have a real connection to EUBACCI, including:
Internal matters (membership-related issues, questions about the interpretation or application of our bylaws/statutes, internal rules, or decisions of EUBACCI’s bodies);
Issues arising from EUBACCI activities (events, delegations, introductions, partnerships or sponsorships organised by or in the name of EUBACCI); and
Member-to-member disagreements, where both parties expressly request a neutral mediation pathway.
What this does not cover
EUBACCI is not a court and does not act as counsel for any party. This process is therefore not designed for disputes with no connection to EUBACCI, criminal matters, or situations where a party asks EUBACCI to provide legal advice or for EUBACCI to “take sides”.
Governance matters (Board / General Meeting)
Some matters cannot be “mediated” as such, because they must be decided through EUBACCI’s statutory bodies. This includes, for example, admission or termination of membership, appointment or revocation of directors, approval of accounts and budgets, discharge, and any other matters reserved by law or our bylaws to the Board of Directors and/or the General Meeting.
In those cases, EUBACCI can still facilitate constructive dialogue, but the final decision will follow the appropriate governance process.
How to submit a request (one single channel)
Please submit your request either:
via our Contact Form (select: “Dispute Resolution / Mediation”), or
by email to our Secretariat at [insert your single official email address].
To preserve neutrality and proper conflict-of-interest safeguards, please do not contact individual Board members directly.
- What to include (short and practical):
- who is involved and how to reach you;
- your link to EUBACCI (member / partner / event participant / other);
- a brief summary of the issue (key facts and dates);
- what outcome you are seeking; and
- essential supporting documents (PDF preferred).
How the process works
Depending on the nature of the matter, EUBACCI will proceed in one (or more) of the following ways:
- Direct dialogue between the parties (online or in person).
- Governance route (where required): if the matter falls within the competence of the Board and/or the General Meeting, it will be handled through the relevant body, in line with our bylaws and internal rules (with conflict-of-interest safeguards).
- Internal conciliation (where appropriate): EUBACCI may facilitate a conciliation meeting and/or appoint a neutral point of contact to support an amicable solution.
- Voluntary mediation: if the matter remains unresolved, the parties are encouraged to attempt mediation with an independent mediator (chosen by agreement; EUBACCI can propose options upon request). Unless agreed otherwise, mediation costs are shared equally.
Confidentiality and “without prejudice”
Discussions and settlement proposals exchanged during dialogue, conciliation and/or mediation are handled confidentially and on a “without prejudice” basis, except where disclosure is required by law or agreed in writing.
For clarity, submissions made via the contact form or email are processed for the purpose of this dispute resolution process, but they do not constitute formal legal notice.
Courts and applicable law (last resort)
If no amicable solution is reached, the dispute may be brought before the French-speaking courts of Brussels, under Belgian law.
